What You Need To Know Before Starting The Sale Of Imported Cosmetic Products
Companies planning to operate in the cosmetics sector as importers must meet a series of legal and technical requirements before offering products for sale in the domestic market. Fulfilling these obligations not only ensures legal compliance but also guarantees product reliability and sustainability in the market. Below is an overview of the key steps to consider before selling imported cosmetics in Turkey
 

       1. Compliance with Cosmetic Legislation: The Legal Framework

Every cosmetic product intended for import must comply with the Turkish Cosmetic Regulation, which is based on the EU Cosmetics Regulation (EC No 1223/2009). This regulation ensures that products are formulated and placed on the market in a manner that does not pose a risk to human health.

Compliance is assessed based on the following criteria
 

 

  • Ingredient Analysis: All raw materials in the formulation must be checked to ensure that no banned or restricted substances are used.

  • Function Classification: The product must fall under the definition of a cosmetic and must not make therapeutic claims.

  • Mechanism of Action: The product must act only on the external surface and must not have a pharmacological effect.

    2. ÜTS Registration: Notification in the Product Tracking System

    The Product Tracking System (ÜTS) is a digital platform operated by the Turkish Medicines and Medical Devices Agency (TİTCK). Every cosmetic product placed on the market in Turkey must be registered in this system.

    The following information is required for ÜTS registration

  • Product name and brand

  • Full formulation and ingredient list (in INCI format)

  • Packaging and usage instructions

  • Importer company information

  • CPSR (Cosmetic Product Safety Report) summary (if required ) 

    Products cannot be legally sold without ÜTS registration. This system ensures traceability and enables recall procedures when necessary. Each variant (e.g., different color or fragrance) must be registered as a separate product.


    3. CPSR: Preparation of Cosmetic Product Safety Report

    The CPSR (Cosmetic Product Safety Report) is a technical and scientific file that must be prepared for each imported cosmetic product. It evaluates whether the product is safe for human use and is a mandatory document aligned with both EU and Turkish regulations.

    The CPSR consists of two main parts

  • Part I – Product Information File (PIF): Includes the formulation, chemical properties of raw materials, microbiological quality, exposure scenarios, and production details.

  • Part II – Safety Assessment: Contains toxicological data, target consumer group, intended use, and a risk assessment.

    This report must be prepared by a certified safety assessor. CPSR preparation is one of the most technical and critical steps in the import process.

    4. Labeling and Packaging Requirements

    Information on the product’s label is essential for both consumer safety and regulatory compliance. Labels must be written in Turkish and comply with the Cosmetic Product Labeling Rules.

    Mandatory labeling elements include:

  • Product brand, name, and function

  • Net quantity

  • Labels with misleading, incomplete, or unsubstantiated claims are considered violations and may result in penalties during inspections.

  • Ingredient list (INCI format)

  • Usage instructions and storage conditions

  • Batch number (LOT/BATCH)

  • Name and address of the Responsible Person

  • Expiry date or Period After Opening (PAO)

  • Warnings and usage restrictions (e.g., “Avoid contact with eyes”)

    5. Barcode and Product Identification Process

    Imported cosmetic products can be registered using the original barcode assigned by the manufacturer. However, if any content, packaging, or labeling is modified specifically for the Turkish market, a new barcode should be assigned and a separate ÜTS notification is recommended. This improves legal traceability and simplifies stock management.

    It is advisable to assign distinct barcodes for product variants (e.g., different scents, volumes, or colors) to maintain data integrity. Barcode systems must also be integrated with GS1 Turkey.
